Level 70 Elite Tauren Chieftain Music Video Contest
Official Rules
Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN. BLIZZARD ENTERTAINMENT, INC. (THE "SPONSOR") IS THE SPONSOR OF THIS LEVEL 70 ELITE TAUREN CHIEFTAIN MUSIC VIDEO CONTEST ("CONTEST"). THIS CONTEST IS OPEN ONLY TO RESIDENTS OF THE UNITED STATES OF AMERICA WHO ARE THIRTEEN (13) YEARS OF AGE OR OLDER AS OF APRIL 18, 2008 ("ENTRANTS"). IF YOU ARE NOT A RESIDENT OF THESE AREAS AND/OR YOU ARE NOT THIRTEEN (13) YEARS OF AGE OR OLDER ON APRIL 18, 2008, YOU ARE NOT ELIGIBLE TO WIN A PRIZE. If you are under the legal age of majority in your state/jurisdiction of residence (a "Minor"), one of your parents or legal guardian must submit a signed, written statement that they have read, understood and agree to these Contest rules along with your entry, and that such agreement constitutes acceptance of these Contest rules on behalf of you and themselves. To be eligible to win a prize, entries must be completed and received by Sponsor only in the format designated below. Any entries received in an alternate format will be disqualified. Directors, officers and employees of Sponsor, or of Comcast Cable Communications Management, LLC or their parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies or partners, and immediate family members of and any persons domiciled with, such employees of each are not eligible to enter the Contest. All applicable federal, state and local laws and regulations apply. Void where prohibited. Limit one entry per household. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address from which the e-mail was sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion. The Sponsor's time clock is the official clock for this Contest. By entering, all entrants and participants further agree to be bound by the terms relating to the use of the Sponsor's website as applicable, including its respective Privacy Policies.
Disclaimer. Sponsor, all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by or arising from entering or attempting to enter the Contest; or (d) any printing or typographical errors in any materials associated with the Contest.
Contest Period. The Contest shall commence on April 18, 2008 at 12:01 AM Pacific Time ("PT"), and end on May 18, 2008 at 11:59 PM PT ("Contest Period").
Prizes.
- Three (3) Grand Prize winners will receive one (1) Ipod Touch 8GB version, with an approximate retail value of $299.00.
- Five (5) First Place winners will receive a prize package consisting of one (1) Logitech G15 keyboard, and one (1) signed edition of the World of Warcraft Battlechest, with an total approximate retail value for the prize package of $129.99.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
Prize winners will be required to execute an affidavit of eligibility before they can receive their Prize. After the receipt by Sponsor of the completed affidavit, a Prize winner will be shipped the Prize within 30 days of the end of the Contest Period. Prizes returned as undeliverable or otherwise not claimed within fifteen (15) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserve the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
How to Enter. Submit your World of Warcraft music video utilizing only music provided by Level 70 Elite Tauren Chieftain via the "Level 70 Elite Tauren Chieftain Music Video" contest submission page (the "Music") located at http://www.worldofwarcraft.com/contests/l70etc-musicvideo/submit.html. Videos can be no larger than 50 megabytes in file size and must be submitted in WMV, MOV, or AVI formats by May 19, 2008 at 12:01 AM PT. All submissions exceeding said limit, and/or including music other than the Music, and/or including any materials which are not entrant's own original work, or encoded in an alternate format will be void. You must fill out the following fields in order to be eligible: First Name, Address 1, Address 2 (if applicable), City, State, Zip/Postal Code, World of Warcraft Account Name (if applicable), and Email.
All footage used in entries must be entirely your own original creation and unreleased at the time of contest submission.
Determination of Winners. Qualified entrants for this Contest may submit videos that depict character(s) from World of Warcraft. The entries shall be judges by a panel of five (5) Judges selected by Sponsor. Sponsor and its Judges, based on their sole discretion, shall judge the videos based equally on composition, creativity, and originality. All decisions of Sponsor and its Judges are final. Sponsor shall choose the winners by May 30, 2008 from all qualified entrants. Prize winners will be notified by e-mail within fourteen (14) days thereafter. To claim a prize, winners must follow the instructions contained in their notification, which may require that Winner provide Sponsor a version of their winning entry in an uncompressed format on a Data DVD. Entrants can only win once during the Contest Period.
Sponsor Use of Entries. You hereby agree that in consideration of your having the opportunity to enter the Contest, you hereby grant Sponsor a perpetual, non-exclusive, worldwide license and right to utilize the video submitted along with any other entry materials that you submit to Sponsor in connection with the Contest (collectively, "Entry Materials"). The Entry Materials will not be returned to any entrant. Without limiting the generality of the foregoing, you acknowledge that Sponsor shall have the right to use, modify, reproduce, publish, perform, display on all forms of media, distribute, make derivative works of and otherwise commercially and noncommercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You agree to take, at Sponsors expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor rights as set forth above in this paragraph 7. You further agree to defend against, indemnify and hold harmless the Release Parties (defined below) from any and all claims arising in connection with the display, publication or use whatsoever of the Entry Materials.
Collection of Information. The information collected to enter the Contest will be used by Sponsor to contact you in the event that you are chosen to receive a prize. In the event that you are under the age of eighteen (18) years and submit an entry to Sponsor, Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from the entry.
General Release. By entering the Contest, you release Sponsor, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest, your Entry Materials, or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, intellectual property rights, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Contest entrant agrees that, by entering the Contest, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Affidavit & Release. As a condition of being awarded any prize, winners or parent or legal guardian of any Winner who is a minor, will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within five (5) days of date of postmark. Winners and/or legal guardian's of winners, will be required to execute, have notarized, and deliver to Sponsor an Affidavit of Eligibility, which includes an acceptance of these Official Rules and a release of liability. Failure to do so will result in disqualification of the winner and an alternate winner will be selected to receive the Prize. Additionally, the winner agrees that entry and/or acceptance of Prize/s constitutes permission for the Sponsor and their agencies to use the winner's name, address (city and state) and/or likeness as well as the Entry Materials for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, including without limitation Internet, unless prohibited by law.
Winners List/Rules Request. For a copy of the winners list, send a stamped, self-addressed, business-size envelope after May 19, 2008 and before December 10, 2008 to Sponsor at the following address: "Level 70 Elite Tauren Chieftain Music Video Contest -Winners List," c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92623. To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the following address: "Level 70 Elite Tauren Chieftain Music Video Contest" -Rules Request," c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92623. Residents of Washington, U.S.A. and Vermont, U.S.A, may omit return postage.
Removal From the Mailing List. To prevent Sponsor from mailing you information regarding future Sweepstakes or promotions being conducted by Sponsors, send a written removal request, specifying the name and address you are requesting to have removed from the mailing list, to "Level 70 Elite Tauren Chieftain Music Video Contest" -Rules Request," c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92623. Sponsor has sixty (60) days to process your request after receipt.

Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, attempt to defraud or tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest and may be prosecuted to the full extent of the law. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
